Welcome to Reserve Pickle Padel Social Club! By using our website www.reservepicklepadel.com and its sub-domains, you agree to abide by the following Terms & Conditions. Empire Pickleball Sdn Bhd operates this website and provides the associated services. Please read these terms carefully before making a booking or using our services.

1. General Terms

1.1 Eligibility:

  • If you are below 18 years of age, you must obtain permission from a legal guardian to place an order or make a booking on our website. By using the purchase functionality and/or placing an order, you accept these Terms & Conditions.

1.2 Amendments:

  • Reserve Pickle Padel Social Club reserves the right to amend these Terms & Conditions at any time. Any changes will take effect no earlier than thirty (30) days after the revised Terms & Conditions have been made available on the website.

2. Booking and Vouchers

2.1 Booking Rates:

  • Court Booking Rates: Court booking rates can be referenced on our website. Reserve Pickle Padel Social Club reserves the right to change these rates at any time.
  • Standard Booking Rate: You can choose your court dates within 14 days from today.
  • Advance Booking Rate: For bookings beyond 14 days and up to 30 days from today, an additional RM20 per hour will apply.
  • Multi-Court Booking: You can book multiple courts in one go, the time slots must be consecutive!

2.2 Special Events and Tournaments:

  • In case of special events or tournaments, Reserve Pickle Padel Social Club reserves the right to contact customers to postpone or re-arrange their booking slot to another time. We will make reasonable efforts to accommodate your preferences and minimize any inconvenience.

3. Ordering and Purchase

3.1 Review and Availability:

  • Before completing your order, you will be given the opportunity to review your selection, including checking the quantity, total price, and correcting any input errors that might prevent you from placing the order successfully. Reserve Pickle Padel Social Club does not guarantee that all items included in your selection are in stock at the time of your ordering. This means that items in your shopping cart are not reserved and may no longer be available once you place your order. In the event that an item is unavailable, we will contact you as soon as possible using the contact information provided at the time of placing your order。

3.2 Order Confirmation:

  • After completing your order on www.reservepicklepadel.com, you will receive an order summary via the email address provided during profile sign-up. The order summary will include your order number, the details of the purchased items, and the total pricing.
  • Please note that the order summary is not an acceptance of your order but simply an acknowledgment that we have received it. Once the order is processed, payment is successfully received, and we have confirmed the availability of the items and the completeness of all required information, you will receive an email confirmation of your purchase at the same email address. You can also track the order confirmation in your user profile on my orders.

3.3 Order Acceptance:

  • We reserve the right, at our discretion, not to accept your order.

4. Prices

4.1 Price Changes:

  • Reserve Pickle Padel Social Club reserves the right to change the prices of items sold on www.reservepicklepadel.com at any time without prior notice. Changes in price will not affect already purchased items.

4.2 Sales and Campaigns:

  • Periodic sales or campaign offers are valid unless otherwise stated, as long as the items are available in stock and/or until the end date of the periodic sale and/or campaign offer is reached under the terms specified in each offer/campaign.

5. Payment and Payment Gateway

5.1 Payment Methods:

  • Payments for orders and bookings can be made using the payment methods available on our website. We support Credit Card (Visa & Mastercard) and E-Wallets through secure payment gateways.

5.2 Payment Gateways:

  • We use Fiuu as our payment gateway to process transactions. Fiuu ensures secure processing of your payment information using encryption and other security measures. For more details, please refer to Stripe's Terms and Conditions here: https://fiuu.com/terms-of-services/my/.

5.3 Payment Confirmation:

  • Upon successful payment, you will receive a confirmation email detailing your payment and booking/order details. If there are any issues with your payment, we will contact you using the information provided during the ordering or booking process.

6. Cancellation and Refunds

6.1 Cancellation Policy:

  • Cancellations are possible up to 24 hours before your scheduled booking.

6.2 Refunds:

  • In the event of a cancellation, Reserve Pickle Padel Social Club will issue a refund in the form of credit to your customer profile at my credits. This credit can be applied toward future bookings. Please note that cash refunds are not available.

7. Usage and Conduct

7.1 Play at Your Own Risk:

  • All activities, including court bookings, coaching sessions, or any other use of the facilities at Reserve Pickle Padel Social Club located at Sunsuria Avenue, Plaza 1, Indoor Complex Persiaran mahogany PJU5, Kota Damansara 47810 Petaling Jaya Selangor Malaysia, are undertaken at your own risk. While we strive to maintain a safe environment, Reserve Pickle Padel Social Club is not responsible for any injuries, accidents, or lost items that may occur during your use of our facilities.

7.2 Safety and Attire:

  • Proper sports attire and sports shoes must be worn while playing on the courts. Failure to comply may result in being denied access to the courts.

7.3 Children:

  • If bringing children, they must be accompanied by a parent or another responsible adult who will ensure their safety at all times

7.4 Cleanliness:

  • Please ensure you clean up after yourself. Dispose of any rubbish in the provided bins and leave the court and surrounding areas in a tidy condition.

7.5 Use of [Padel/Pickleball Courts/Massage/Infrared Sauna/Ice Plunge/ Event Space]

7.5.1 Assumption of Risk and Waiver of Liability

By entering and using the Padel/Pickleball court/ Massage/Infrared Sauna/Ice Plunge/ Event Space facilities owned and operated by Reserve Pickle Padel Social Club (“the Owner”), all players and visitors expressly acknowledge and agree to the following:

7.5.1.1 Voluntary Participation

  • All players participate in padel and other activities at their own risk. [Padel/Pickleball court/ Massage/Infrared Sauna/Ice Plunge/ Event Space] a physically demanding sport that carries inherent risks, including but not limited to, slips, falls, collisions, equipment-related injuries, heat exhaustion, and other potential hazards

7.5.1.2 Assumption of Risk

  • Each participant accepts full responsibility for any injury, loss, or damage (including to personal property) that may result from their use of the court facilities, whether arising from their own actions, the actions of others, or unforeseen circumstances.

7.5.1.3 Waiver and Release of Liability

  • To the fullest extent permitted by law, players and visitors hereby waive all rights to make any claim against the Owner, its directors, employees, agents, or contractors for any personal injury, illness, property damage, or other loss suffered while on the premises, regardless of cause, including negligence, breach of statutory duty, or otherwise.

7.5.1.4 Exclusion of Liability

  • The Owner shall not be liable for any death or personal injury unless caused by the gross negligence or wilful misconduct of the Owner. The Owner is not liable for injury or damage caused by other players, third parties, environmental conditions, or faulty personal equipment.

7.5.1.5 Medical Fitness

  • Players are responsible for ensuring they are medically fit to participate. The Owner does not provide medical supervision or assessment and accepts no liability for any health-related issues arising during or after court use.

7.5.2 Court Rules and Safety

  • All players must wear appropriate footwear and attire.
  • No playing under the influence of alcohol or drugs.
  • Players must act in a safe and respectful manner.
  • Report any incidents or hazards to management immediately.
  • Children under 12 must be supervised by an adult at all times.

7.5.3 Agreement to Terms

  • By booking or using the padel/pickleball court/ Massage/Infrared Sauna/Ice Plunge/ Event Space court, all users confirm they have read, understood, and agreed to these Terms and Conditions.

8. Facilities and Services

8.1 Available Facilities:

  • We provide various facilities including [showers, infrared sauna, an ice bath, massage]. Parking is also available. For any questions or concerns, please refer to our ground staff.

8.2 Facility Usage:

  • Facilities such as the shower, infrared sauna, ice bath, massage available for use by patrons. Proper conduct and respect for other users are expected at all times.

9. Liability

9.1 Limitation of Liability:

  • Reserve Pickle Padel Social Club shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our website or facilities.

9.2 Indemnification:

  • You agree to indemnify and hold harmless Empire Pickleball Sdn Bhd its employees, and affiliates from any claims or damages arising from your use of our services.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Malaysia.
